New Mexico Courts Rule Public Can Wade Streams On Private Property

The New Mexico Supreme Court has ruled again in support of public access to public waters in a Thursday decision that confirms the public’s right to walk or wade streambeds crossing privately owned lands.

Prior to this ruling, land owners were able to petition the Game Commission that the waters on their land were non-navigable and, therefore, should remain entirely private.

Um, no, said the court.
