Judge says Forest Service can continue dropping wildfire retardant

In response to a lawsuit by a group of current and former Forest Service employees, a federal judge said the United States Forest Service could continue using aerial retardant to fight wildfires. At the same time, it seeks a permit under the act that governs water pollution.

The judge also acknowledged in his ruling that the Forest Service violated the Clean Water Act in certain instances when it dropped retardant in waterways.
